Terms & Conditions

All THE DELHI WAY participants must be over the age of 18 at the time of booking.THE DELHI WAY recommends every Participant to carefully read the terms and conditions and bookings are done on the basis that the Participants are agreeable to all the terms and conditions enumerated below.

 1. BOOKING AND PAYMENTS

1.1     To make a booking and guarantee your participation on THE DELHI WAY expedition, you must agree to the terms and conditions listed below and provide complete payment in advance.  THE DELHI WAY would accept booking on the understanding that full payment has been collected and held by THE DELHI WAY directly.

1.2       Booking confirmation by the Participants can be made via email on info@thedelhiway.com or telephonically. Upon confirmation of your booking and receipt of full payment, subject to availability and at the discretion of THE DELHI WAY, we will reserve your seat on the selected expedition. It is the responsibility of you, the Participant, to check the accuracy of the booking and the dates of travel. No refunds will be issued for mistakes made by the Participant during the booking process including the wrong date booked.

1.3       Upon confirmation of your booking, THE DELHI WAY will issue you a confirmation email. It is your responsibility to keep and maintain record of your booking and confirmation. 

1.4       In case of any cancellation of bookings, the same have to be done 48 hours in advance of the date of scheduled travel. In the event no cancellation information is given or no show by the Participant, THE DELHI WAY reserves its right to forfeit the booking amount without any prior intimation. 

1.5      The booking charge does not include Personal Insurance coverage (personal loss, illness or damages incurred during trip), Monument entrance fee, video camera /camera charges applicable inside the monuments. 

2. THE DELHI WAY- MODUS OPERANDI

2.1      Unless otherwise stated in the trip itinerary, THE DELHI WAY will provide a tour manager to accompany the Participant and supply insights and knowledge of the city as well as showcase a number of activities over a period of time specified by the itinerary. Additionally, THE DELHI WAY may provide you with guided tours of popular city sites and areas, when practical and possible.

2.2      The itinerary and activities provided are subject to change and no substitutions will be made for missed or cancelled activities due to unforeseen events including but not limited to: acts of God, detention, annoyance, delays, and expenses arising from quarantine, strikes, thefts, pilferage, failure of any means of conveyance to arrive or depart as scheduled, civil disturbances, government restrictions or regulations, discrepancies or changes in transit over which it has no control including strikes. Reasonable changes in itinerary may be made where deemed advisable for the comfort and well-being of the participants.

2.3       Depending on the type of trip and itinerary, other services including, transportation, activities are offered through third party (cab company, Tour Guides, Yoga instructor, restaurant services etc). The third party services are subject to the terms and conditions, and limitations of liability, imposed by the third party service provider. All arrangements are made independently of THE DELHI WAY, regardless of the booking of such arrangements by THE DELHI WAY. Any person employed or engaged by third party service providers shall under no circumstances be deemed to be employees of or associated with THE DELHI WAY and THE DELHI WAY shall in no way be held responsible for any actions, liabilities or claims of any nature arising out of the services provided by such third-party service providers. 

3. PARTICIPANT RESPONSIBILITIES

3.1     It is your responsibility to make sure you have a valid passport, and all necessary visas, permits or certificates on your person for your selected trip. THE DELHI WAY is not liable for any problems, delays or denied entry in the event you are not in possession of valid travel documents.

3.2     You agree to comply with the authority of THE DELHI WAY tour manager/travel advisor, and the laws and regulations of the countries visited, including customs and foreign exchange regulations and restrictions. If you do not comply with said reservations, you will be asked by THE DELHI WAY tour manager/travel advisor to leave the trip. You are not eligible for refunds under such circumstances.

3.3       There may be times when the THE DELHI WAY tour manager must make a decision for the safety and/or best interests of the group. It is a condition of booking that you agree to comply with the authority and decisions of  THE DELHI WAY tour manager. If you do not comply, or if in the opinion of  THE DELHI WAY tour manager, you are not compatible with the general enjoyment of the group or the smooth operation of the trip, THE DELHI WAY reserves the right to refuse to allow you to continue with the trip. You agree that THE DELHI WAY has the exclusive right to dispel you from a trip at anytime, without any claims or complaints by you against THE DELHI WAY. In such a case THE DELHI WAY will not be liable for any refund, compensation, or additional costs incurred by you.

3.4      It is your responsibility to meet the transport provider or tour manager provided by THE DELHI WAY at the correct time and location, as specified in your trip details and itinerary. In the event you miss a planned departure, any extra travel costs incurred are to be borne by you. It is your responsibility to check in with the THE DELHI WAY tour manager 15 minutes prior to the specified departure time. Due to the nature of the services provided, THE DELHI WAY will not be liable if any service departs or arrives later than the specified time, even if as a result you miss a connecting service.

3.5      THE DELHI WAY shall not be held responsible for your personal belongings at any time including while in the arranged accommodations as well as out in the visited city. It is your responsibility to look after your belongings. THE DELHI WAY cannot be held responsible for loss, theft or damage to any of your personal belongings, regardless of the circumstances.

3.6       Due to the consistent needs of the group as a whole, THE DELHI WAY tour managers cannot offer constant special attention or assistance should you have any physical disability requiring such attention. 

3.7     The experiences offered on the site may be adventurous in nature and may involve some personal risk. The DELHI WAY is released from all such risks (release from all claims & causes of action arising from any damages or injuries or death, resulting from these inherent risks). 

3.8       You agree that THE DELHI WAY may take photographs and films while you are participating on a THE DELHI WAY trip. You agree that these images may be used for marketing and/or promotional purposes by THE DELHI WAY. These images may be used in, but are not limited to, brochures, pamphlets, websites, print media and promotional videos. These images may be used for publicity and advertising without THE DELHI WAY obtaining further consent or payment for the use of the images.

3.9       THE DELHI WAY does not in any way condone or encourage the consumption of alcoholic beverages. While THE DELHI WAY tours operate in the city where the drinking age is 25, THE DELHI WAY cannot be held responsible for those under 25 yrs, who decide to consume alcoholic beverages. 

3.10    Those who do drink alcohol, regardless of age, do so at their own risk and accept full responsibility for their actions as the result of such activity. THE DELHI WAY is not liable or responsible for any results, consequences, damages, fines, etc. arising out of such activity, including but not limited to, personal injury or death, property damage, imprisonment, fines, expulsion from tours, or any other negative consequences. THE DELHI WAY strongly encourages tour members to always act responsibly and in compliance with all local and federal laws and guidelines. 

3.11    The consumption of street food or otherwise, would be purely at the risk of the Participant and THE DELHI WAY will in no way be responsible, in case of any sickness arising after such food consumption.

3.12    PRESCRIBED MEDICATION CLAUSE. Every THE DELHI WAY tour member or client must continue to take all physician-prescribed medication while on a THE DELHI WAY tour. Any costs arising from situations or emergencies that result from complications of not taking prescribed medication are the sole responsibility of that tour member, and THE DELHI WAY will not be liable. In addition, that tour member will be held responsible for costs to continued business of THE DELHI WAY arising from emergencies relating to this issue.

3.13     The Delhi Way uses a third party service to process your credit card information. For further information regarding that service please contact card processing company. You hereby agree to hold The Delhi Way harmless for any damages that may result should any personal information about you be released by any third parties.

4. INSURANCE

4.1     There is no travel, travel accident, accident, or medical insurance included in the cost of any THE DELHI WAY trip or package, ticket, or product unless otherwise explicitly stated.

4.2     THE DELHI WAY strongly recommends that you are covered by a comprehensive insurance policy which includes: personal accident, medical expenses, emergency repatriation, personal baggage, money and public liability, and any other international insurance required. By entering into this agreement, you affirm that you have been advised by THE DELHI WAY to purchase and be covered by your own international emergency medical insurance that covers all segments of your travels.

4.3      To be clear, no refunds can be issued in the event of illness, missed travel connections, lost baggage or anything of the like. This is a travel insurance issue, not a tour operator issue.

5. WEATHER, ENVIRONMENT AND POLITICAL CONDITIONS

5.1       THE DELHI WAY shall not be held responsible for any delay, deviation, or cancellation due to weather conditions. No trip may be cancelled or changed by you at anytime on the basis of weather conditions.

5.2     THE DELHI WAY shall not be held responsible for delays due to labor disputes (including strikes that are previously announced or spontaneous), border problems or other political or economic factors.

5.3       THE DELHI WAY shall not be held responsible for delays due to mechanical failure, or other issues that may arise and are outside our control.

5.4       THE DELHI WAY shall not be held responsible for delays or cancellations due to hostile political environments or other issues that may arise due to this and are outside our control. THE DELHI WAY at any time may deem it unsafe to run tours in various destinations due to political unrest and may not be held responsible for these cancellations.

6. GENERAL WAIVER OF LIABILITY

I agree and understand that I hold THE DELHI WAY, its officers, partners, employees and agents harmless from all liability and claims arising out of or in connection with my participation in this purchased trip including but not limited to the dangers involved with travelling and adventure activities. I hereby release and discharge THE DELHI WAY and its officers, partners, employees and agents from all liability arising out of or in connection with the purchased trip. I understand that my participation in the purchased trip and in any of its activities–organized or not–is voluntary, is not required and is at will. 

7. ARBITRATION AGREEMENT

Any and all disputes, controversies, or claims arising out of or relating to this agreement, between THE DELHI WAY and you, including without limitation, claims based on contract, tort, or statute, shall be determined under Arbitration and Conciliation Act, 1996 as amended from time to time by appointing some neutral agency acceptable to both the parties and if no agency is found acceptable to both the parties, then by constituting an Arbitral Tribunal consisting of Three Arbitrators, one to be nominated/appointed by each party and the third to be appointed by the two arbitrators as Umpire. The Arbitration proceedings shall be held at New Delhi, India and the applicable law shall Indian Laws. The decision of the Arbitral Tribunal shall be final and binding on both parties hereto. The Arbitral Tribunal shall record their reasons for passing Awards and copies of which shall be sent to the parties herein.
